The documents we produce are drafts for your review and should not be signed without first obtaining independent legal advice (ILA) from a qualified family lawyer in your jurisdiction.
Using FairWell reduces the time and cost of document preparation. It does not replace a lawyer.

FairWell is designed for agreed or negotiated separations where both parties are willing to reach a settlement. It is not designed for contested matters requiring legal advocacy, court appearances, or enforcement proceedings.

All prices are shown in Canadian dollars (CAD) or US dollars (USD) as indicated. Payment is processed securely by Stripe. FairWell does not store your payment card information.

Documents produced by FairWell are drafts based on the information you provide and the laws of your stated jurisdiction at the time of preparation. They are intended as a starting point for review by a qualified lawyer, not as final, execution-ready agreements.
Laws change. FairWell makes reasonable efforts to keep our document templates current but does not guarantee that every document reflects the most recent legislative changes in every jurisdiction.
A separation agreement or other family law document is only legally binding when signed by both parties with the required formalities (including, in most Canadian provinces, witnesses and independent legal advice). FairWell's delivery of a draft document does not constitute completion of those formalities.

Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.
FairWell's website, branding, document templates, and software are the property of FairWell. You may not copy, reproduce, or distribute them without written permission.
The completed documents produced for you using your information belong to you. You are free to share them with your lawyer, former partner, or any professional involved in your separation.
We reserve the right to suspend or terminate your access to FairWell if you breach these terms, provide materially false information, or use our service for any unlawful purpose. In such cases, no refund will be issued.
These terms are governed by applicable law in the jurisdiction where FairWell operates. Any dispute arising from these terms or your use of FairWell that cannot be resolved informally will be subject to binding arbitration or resolved through the courts, as mutually agreed by both parties.
We may update these terms from time to time. The effective date at the top of this page will be updated when we do. Continued use of FairWell after a change constitutes acceptance of the revised terms. For significant changes, we will notify active clients by email.
