1. What FairWell is and is not

FairWell (operated by FairWell Technologies, "FairWell", "we", "us") provides general legal information, decision-support tools, coaching, preparation services that organise your information into structured summaries, and a directory and booking platform for independent professionals. FairWell is not a law firm, does not practise law, and does not provide legal, financial, tax, medical or psychological advice. Nothing on the site, in any document we prepare, in any communication with us, or in any session with a professional booked through the site creates a lawyer-client, fiduciary, advisory or therapeutic relationship with FairWell.

Family law differs by province and state and changes over time. Information on the site may be incomplete, out of date or inapplicable to your circumstances. You are solely responsible for confirming anything you rely on with a qualified professional licensed in your jurisdiction.

2. Documents and tools

Summaries, organisers and other outputs prepared through FairWell are structured, plain-language summaries of information you and, where applicable, your partner provide. They are not legal documents, legal instruments or legal advice, and FairWell does not draft agreements. A lawyer (or, where applicable, a notary or mediator) licensed in your jurisdiction should prepare any legal agreement and advise you before you sign anything. Any turnaround times we mention are typical estimates, not guarantees, and depend on how quickly complete information is received. We do not review the accuracy or completeness of the information you provide and are not responsible for any document, calculation, roadmap or output that is wrong, incomplete or unenforceable because of information you provided, because of the law in your jurisdiction, or because of how the document was used, modified or executed.

Calculators, estimators, roadmaps, assessments and comparisons produce approximations for information purposes only. They are not predictions of any outcome and must not be relied on as such.

3. Professionals and the marketplace

Professionals listed in the directory, hosting events, or offering services through the site are independent third parties, not employees, agents or partners of FairWell. We verify certain credentials against public registries at the time of listing but do not guarantee any professional's qualifications, availability, conduct, advice, work product, fees or outcomes, and we do not supervise their services.

When you book or pay a professional through the site, your contract for that service is with the professional, not with FairWell. FairWell provides the booking and payment technology only. The professional is responsible for delivering the service, for its quality, for scheduling and meeting links, and for refunds, cancellations, chargebacks and disputes relating to their service. FairWell may charge the professional a platform fee and may, at its sole discretion and without obligation, assist in resolving a dispute.

Listings, ratings and reviews reflect the views of the people who submitted them. FairWell does not endorse any professional and is not responsible for the content of any listing or review.

4. Purchases, pricing, refunds

Prices are shown in Canadian dollars for Canada (plus applicable tax) and US dollars for the United States, based on the location you choose or that your connection suggests, and are charged through Stripe. Refunds of the FairWell fee: you get a full refund any time before you start your intake. After you start, if we do not deliver what the product page describes, we will fix it or refund you; write to hello@fairwell.ai within 30 days of delivery. If you stop for safety reasons, we refund you in full. Memberships can be cancelled at any time and run to the end of the period you paid for; add-on services delivered by professionals and bookings are governed by section 3. Taxes may apply. We may change prices at any time; changes do not affect completed purchases.

5. Your responsibilities

You agree that you are at least 18, that the information you provide is accurate and complete, that you have the right to provide any information about another person, that you will not use the site to harass, defraud, impersonate or harm anyone, that you will not scrape, copy, resell or reverse-engineer any part of the site or its content, and that you will not use the site where doing so is unlawful. If you use the collaboration feature, you are responsible for your own inputs only and acknowledge that your partner's inputs are theirs.

6. Accounts, professionals' obligations

Professionals who list on the site represent that they hold, and will maintain, every licence, registration, insurance and qualification required to provide their services in the jurisdictions they serve; that they will comply with the rules of their regulator, including advertising and referral rules; that they will not hold FairWell out as their partner or employer; that they will deliver services booked through the site or refund the client; and that they are solely responsible for their content, their advice, their tax and their professional conduct. Lawyers may list contact information only and may not sell services through the platform. FairWell may remove any listing, service or content at any time for any reason.

7. Intellectual property

The site, its design, text, guides, tools, templates, document structures, code and trademarks are owned by FairWell or its licensors. You receive a limited, personal, non-transferable licence to use documents prepared for you for your own separation or agreement. All other rights are reserved. Content you submit (including reviews, stories and event proposals) may be used, edited and published by FairWell in connection with the service; you warrant you have the right to submit it.

8. No warranty

The site, all content, all tools, all documents and all services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, merchantability, non-infringement or that any document will be accepted by any court, lawyer, institution or other party. We do not warrant that the site will be uninterrupted, error-free or secure.

9. Limitation of liability

To the fullest extent permitted by law, FairWell, its owners, directors, employees, contractors, advisors and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, savings, data, goodwill or opportunity, or for any legal, financial, custodial or other outcome of your separation, agreement, litigation or dealings with any professional, however caused and under any theory of liability, even if advised of the possibility. Our total aggregate liability to you for any claim arising out of or relating to the site, any product or any service is limited to the greater of the amount you paid to FairWell (excluding amounts paid to professionals) in the twelve months before the claim, or one hundred dollars ($100). Some jurisdictions do not allow some exclusions; in those jurisdictions our liability is limited to the smallest amount permitted.

10. Indemnity

You agree to indemnify and hold harmless FairWell and the persons listed in section 9 from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising from your use of the site, your breach of these terms, information you provided, any document you signed, or any dealing between you and a professional or your partner. Professionals additionally indemnify FairWell against any claim arising from their services, advice, conduct, content or breach of their regulator's rules.

11. Safety and emergencies

The site is not an emergency service. If you are in danger, contact local emergency services. Quick exit features are conveniences and do not guarantee privacy on any device.

12. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason including breach of these terms. Sections 3 and 7 to 15 survive termination.

13. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Any dispute that cannot be resolved informally within 30 days of written notice will be resolved by binding arbitration administered by a single arbitrator in Ontario under the Arbitration Act, 1991 (Ontario), in English, on an individual basis; you waive any right to a class or representative proceeding. Either party may seek injunctive relief in court for intellectual property or unauthorised access. Where applicable law does not permit mandatory arbitration, the courts of Ontario have exclusive jurisdiction. Any claim must be brought within one year of the event giving rise to it.

14. Changes

We may update these terms by posting a new version with a new effective date. Continued use after posting is acceptance.

15. General

These terms, the privacy policy and any product-specific terms are the entire agreement between you and FairWell. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may. Contact: hello@fairwell.ai.
