Property division
The Family Property Act provides for equal sharing of family assets and commercial assets acquired during the marriage or common-law relationship (after three years or registration).
Child and spousal support
Federal Child Support Guidelines; Manitoba has a Child Support Service that can calculate and recalculate table amounts. Divorce is federal under the Divorce Act: one year living separate and apart (or adultery or cruelty). Child support for divorcing parents follows the Federal Child Support Guidelines; spousal support is guided by the Spousal Support Advisory Guidelines.
Filing for divorce
Court: Court of King's Bench (Family Division)Divorce is filed in the Court of King's Bench; a Family Division resolution process requires most parties to attempt resolution before trial. Fees in the low hundreds; waivers available.
Pensions
Pension credits earned during the relationship are divided under the Pension Benefits Act.
Deadlines
Property accounting claims are generally brought within a set period after separation or divorce; confirm current limits.
Enforcement and legal aid
Support is enforced by the Maintenance Enforcement Program. Support orders and filed agreements can be registered with the provincial maintenance enforcement program, which collects through wage garnishment, licence suspension and federal interception. Legal aid: Legal Aid Manitoba.
